TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the mobile applications, websites, and related services (collectively, the "Services") provided by Dynamo ("Dynamo," "we," "us," or "our"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Use of the Services

You may use the Services only in compliance with these Terms and all applicable laws. You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the Services. If you use the Services on behalf of someone else, you represent that you are authorized to accept these Terms on their behalf.

Accounts

Some features may require an account. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

Your content

Some Services let you create content, such as custom game decks. You retain ownership of your content. By submitting content, you grant Dynamo a worldwide, non-exclusive, royalty-free license to host, store, display, and process it as needed to operate and improve the Services. You are responsible for your content and must have the rights necessary to share it.

Acceptable use

You agree not to:

• Use the Services for any unlawful purpose;
• Reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
• Interfere with or disrupt the Services or their security features;
• Submit content that is unlawful, infringing, or harmful to others;
• Use automated means to access the Services without our permission.

Intellectual property

The Services, including all software, designs, text, graphics, and logos (excluding your content), are owned by Dynamo or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

Purchases

If an app offers purchases, they are processed by the relevant app store (such as the Apple App Store or Google Play) under that store's terms. Except where required by law, purchases are final and non-refundable.

Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services if you violate these Terms or if we discontinue the Services, with or without notice.

Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYNAMO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS ($50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

Changes to the Services or Terms

We may modify the Services or these Terms at any time. If we make material changes to these Terms, we will update the date above and, where appropriate, provide additional notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Any disputes will be resolved in the state or federal courts located in New York, and you consent to their jurisdiction.
